By accessing or using bitkelex, you agree to be bound by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree, do not use the platform.

You must be at least 16 years old to use bitkelex. If you are between 16 and 18 (or the age of majority where you live), you may use the platform only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. You are responsible for ensuring that your use of the platform is lawful in your jurisdiction.

bitkelex is an online learning and training platform offering structured online courses, training programs, practice modules, progress tracking, and certificate issuance for eligible courses. Content may include text, video, quizzes, exercises, templates, and other educational materials.

The platform is designed for educational purposes. We may provide course outlines, learning objectives, and recommended schedules. We do not provide employment placement, licensing guarantees, or outcomes assurances. Learning results depend on factors such as your prior knowledge, time invested, and practice quality.

Some features may require an account, a subscription, or a one time purchase. Plan details and what is included are described on our Pricing page. We may update course content to keep it current, improve clarity, or correct errors.

You agree to use bitkelex only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the platform. You are responsible for your activity on the platform, including maintaining the confidentiality of your login credentials.

You agree that you will not share purchased course access, subscription access, or account credentials with others. Unless a team plan explicitly authorizes multiple seats, one account is intended for one individual. If we detect unauthorized sharing, we may suspend access as described in the Termination section.

You are responsible for ensuring that the information you provide to us is accurate, complete, and up to date, including contact details necessary for account recovery and support communications.

All content and materials on bitkelex, including the website design, text, graphics, logos, videos, lesson content, templates, software code, and user interface elements, are owned by Bitkelex Learning, Inc. or its licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non exclusive, non transferable, revocable license to access and use the platform and course content for your personal, non commercial learning purposes. You may not reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit any part of the platform or course materials without our prior written permission.

The bitkelex name, logo, and related marks are trademarks of Bitkelex Learning, Inc. You may not use our trademarks in a way that suggests endorsement or partnership without written authorization.

To protect learners and maintain the integrity of the platform, you agree not to engage in any of the following prohibited activities:

• Accessing the platform for illegal purposes or in violation of applicable laws.
• Scraping, crawling, harvesting, or collecting content or data using automated tools without permission.
• Reverse engineering, decompiling, disassembling, or attempting to discover source code or underlying algorithms of the platform.
• Impersonating any person or entity, or misrepresenting your affiliation with a person or organization.
• Uploading, transmitting, or distributing malware, viruses, or any code intended to disrupt or harm systems.
• Attempting to bypass security or access controls, including probing or scanning for vulnerabilities.
• Spamming, sending unsolicited messages, or using the platform to distribute promotional content without authorization.
• Sharing accounts, reselling access, or making course content available to others outside permitted use.
• Posting content that infringes third party rights, including copyright, trademark, privacy, or publicity rights.
• Interfering with the normal operation of the platform, including introducing disproportionate load on infrastructure.

We may investigate suspected violations and may suspend or terminate access where appropriate, as described below.

bitkelex is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Bitkelex Learning, Inc. disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the platform will be uninterrupted, error free, secure, or free of harmful components. We do not warrant that course content will be complete, accurate, or suitable for your specific goals. Educational content is intended to support learning, not to serve as professional advice.

To the fullest extent permitted by law, Bitkelex Learning, Inc. and its officers, directors, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption, or other intangible losses, arising out of or related to your use of or inability to use the platform.

To the fullest extent permitted by law, our total direct liability for any claim arising out of or relating to these Terms or the platform will not exceed the amount you paid to Bitkelex Learning, Inc. in the twelve months preceding the event giving rise to the claim, or 100 EUR, whichever is lower.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Bitkelex Learning, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your infringement of any third party rights; or (d) your unlawful conduct.

The platform may reference or link to third party websites or services for convenience, such as tools, resources, or external reading. We do not control third party sites and are not responsible for their content, availability, security, or privacy practices.

Your interactions with third party websites are governed by the terms and policies of those third parties. You access them at your own risk.

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you acknowledge that you have read and understood the Privacy Policy.

Cookie preferences can be managed using the "Manage cookie preferences" link in the footer of the website.

These Terms and any dispute or claim arising out of or relating to them will be governed by and construed in accordance with the laws of the State of New York and the federal laws of the United States applicable therein, without regard to conflict of laws principles.

Subject to the Dispute Resolution section, the courts located in New York County, New York will have exclusive jurisdiction over any disputes arising out of or related to these Terms or the platform.

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us and providing a brief description of the issue and the relief you are seeking. We will make a good faith effort to resolve disputes within a 30 day period.

If the dispute is not resolved within 30 days of the initial notice, either party may pursue a claim in the courts specified in the Governing Law section, unless applicable law provides you the right to bring the claim in a different forum.

We may suspend or terminate your access to bitkelex at any time if we believe you have violated these Terms, if required by law, or to protect the security and integrity of the platform. Suspension or termination may occur with or without notice, depending on the circumstances.

Upon termination, your right to access the platform will cease. Sections intended to survive termination will survive, including: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provisions that by their nature should survive.

We may update these Terms from time to time to reflect changes in the platform, legal requirements, or business practices. Changes will become effective 14 days after we post the updated Terms on this page.

If you continue to use the platform after the effective date, you agree to the updated Terms. If you do not agree to the updated Terms, you must stop using the platform before the effective date.
